Introduction

These Terms and Conditions govern the use of the online ticket store operated by the Open Home Foundation (hereinafter referred to as 'we', 'our', or 'us'). By placing an order through our website at events.openhomefoundation.org or its embedded version at sotoh.openhomefoundation.org, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any order.

Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to place orders on our online ticket store.

Orders and Features of Events

When you click the "Order now" button on our website, a contract for the participation in the selected event is concluded between you and the Open Home Foundation, Grabenstrasse 25, 6340 Baar, Switzerland, Email: hello@openhomefoundation.org.

All tickets displayed on our website are subject to availability. We reserve the right to limit the number of tickets per order and to refuse or cancel any order at our discretion. The information on the website (descriptions, images and other features) are only to be understood as approximate representations and do not represent any warranty or guarantee of specific features of an event, unless they are expressly designated in writing as binding.

Participation in an event may be subject to specific rules, requirements or instructions issued, which must be complied with by participants. Failure to comply with such rules may result in exclusion from the event, without any entitlement to a refund, to the extent permitted by applicable law.

We want every attendee to feel welcome at the event, regardless of gender, identity, age, sexual orientation, disability, race, ethnicity, or religion. By purchasing a State of the Open Home ticket, you agree to adhere to our Code of Conduct:

Examples of behavior that contributes to a positive environment during State of the Open Home include:

  • Demonstrating empathy and kindness toward other attendees
  • Being respectful of differing opinions, viewpoints, and experiences
  • Giving and gracefully accepting constructive feedback
  • Accepting responsibility and apologizing to those affected by our mistakes, and learning from the experience.

Unacceptable Behavior

Examples of behavior that is considered unacceptable during State of the Open Home include:

  • Demeaning communication, insults, or any other kind of personal attack.
  • Unwanted filming or photographing. Not everyone feels comfortable with this, so please ask before doing so.
  • Public or private harassment or intimidation.
  • Inappropriate or unwanted physical contact.
  • Unwelcome sexual attention.
  • Other conduct that could reasonably be considered inappropriate in a professional setting.

In case of violations of this Code of Conduct, the Open Home Foundation reserves the right to remove the individual from the event.

Venue Rules

Attendees must also comply with TivoliVredenburg's house rules. The venue reserves the right to deny admission for any violations of their safety and security policies.

Pricing and Payment

For events where participation is paid, all prices are listed in the applicable currency and include taxes where required by law. Prices may be amended without notice. Payment must be made using the methods specified on our website. We reserve the right to correct any pricing errors before or after an order is placed.

Delivery, Form of Ticket and Event Access

Tickets are delivered electronically after successful completion of the order process, in particular by email or by making them available for download or access on the website. Electronic tickets may, in particular, be issued in the form of a unique access code (e.g. QR code or alphanumeric code) that entitles the holder to participate in or access the event. No identity check is carried out by us at the time of access or participation. We are therefore entitled to grant access to the event to any person who presents or submits a valid access code and shall be deemed to have duly fulfilled our contractual obligations once access to the event has been granted on the basis of such code. You are responsible for keeping the access code secure and preventing unauthorised use. Any misuse of the access code, including use by third parties, shall be at your risk.

Withdrawal

No Right of withdrawal for certain contracts

In accordance with the relevant regulations within the European Union, which might be applicable, there is no right of withdrawal for services related to leisure activities if the contract provides for a specific date or period of performance. Furthermore, the right of withdrawal expires prematurely if we have provided the service in full with your prior express consent and you have simultaneously confirmed your knowledge that you lose your right of withdrawal upon complete fulfilment of the contract; for digital content not provided on a physical data carrier, it expires if we have begun execution with your express consent before the expiry of the withdrawal period and you have confirmed your knowledge that you thereby lose your right of withdrawal.

Right of withdrawal for other contracts

You have the right to withdraw from any contract concluded on the online ticket store of Open Home Foundation within fourteen (14) days without giving any reason. The withdrawal period begins on the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear statement (e.g., a letter sent by post or an email). You can contact us at:

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.

Effects of withdrawal

We will refund all payments received from you without undue delay and at the latest within fourteen days from the day we receive your notice of your withdrawal from the contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you. You will not be charged for this refund.

If you have requested that the services commence during the withdrawal period, you shall be required to pay us an appropriate amount corresponding to the proportion of the services already provided up to the time at which you notify us of the exercise of your right of withdrawal in respect of this contract, relative to the total scope of the services provided for under the contract.

Cancellation or Postponement of Events

We reserve the right to cancel or postpone an event for material reasons. In the event of cancellation of an event, the ticket price paid for the affected event shall be refunded to you without undue delay, unless the cancellation is due to an event of force majeure. In the event of a postponement, your ticket shall remain valid for the rescheduled date. If you are unable to attend the event on the new date, you may request a refund of the ticket price, unless the postponement is due to an event of force majeure.

For the purposes of these Terms, force majeure means any event beyond our reasonable control which could not have been foreseen or avoided even with due care, including in particular natural disasters, epidemics or pandemics, acts of government or authorities, war, terrorism, civil unrest, strikes, or failures of public utilities or telecommunications networks.

Any further claims, in particular claims for compensation of travel, accommodation or other ancillary costs, are excluded to the extent permitted by applicable law.

Contact Form

You are responsible for ensuring that any information or input you provide to the Open Home Foundation, whether through the contact form on the website or otherwise, is, to the best of your knowledge, accurate and relevant. Unless otherwise agreed, the Open Home Foundation may rely on such information without independent verification. While we will do our best to respond to queries and comments sent through the contact form on the website, communications via the contact form do not constitute formal notice to the Open Home Foundation.

Intellectual Property

Unless otherwise stated, all content on our website at events.openhomefoundation.org or its embedded version at sotoh.openhomefoundation.org, including images, logos, and text, is the property of the Open Home Foundation and protected by intellectual property laws. You may not use, reproduce, or distribute any content without prior written permission of the Open Home Foundation.

Privacy

Your personal data will be processed in accordance with our Privacy Policy, which is available here.

Limitation of Liability

To the maximum extent permitted by law, we exclude all liability for any indirect or consequential damages arising from your use of our online shop. Our total liability shall not exceed the amount paid for the ordered items.

If you are a consumer (i.e. purchasing goods for purposes outside your trade, business or profession), nothing in these Terms and Conditions limits your non-waivable statutory rights under the law of your country of delivery.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Switzerland, excluding its conflict of law provisions and the UNCITRAL convention on the international sale of goods. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the Canton of Zug, Switzerland.

Changes to Terms

We reserve the right to amend these Terms and Conditions at any time. Changes will be effective upon posting on our website. It is your responsibility to review these Terms periodically.

If any provision of these Terms and Conditions is found to be invalid, this shall not affect the validity of the remaining provisions or the Terms and Conditions as a whole.
